Quorum – Majority of the members – At least half plus one (1) member.

Purpose
a) To contribute to and develop strategy and policy both for the Shoalhaven City Council as well as in alignment with the Region.
b) To develop and implement policy, planning and vision for the broad arts within existing resources and use a co-opted panel of peers for professional advice. They include:
· Visual Arts
· Heritage and Museum Sector
· Literature
· Performing Arts
c) Advocate and maintain specific arts related portfolios.
d) Advocate and promote Board recommendations.
Delegated Authority
· Act within adopted budgets aligning with Council’s strategic plans and document, and make recommendations on the arts to Council.
· Appoint suitable representatives to fill casual vacancies on a set term basis.
· Inform and recommend policy for arts related funding programs, and where required by Council, vote on related matters.
· Establish a peer panel of professionals, experts and practitioners across art forms, heritage and cultural platforms to be co-opted as needed for input and advice to the Shoalhaven Arts Board.
· Establish a Shoalhaven Arts Foundation:
o To support the development and enrichment of broad arts across the Shoalhaven including visual, heritage, literature & performing arts
o To ensure that the Foundation in its governance, membership and charter are independent/ and at arms-length from Council yet works in concert with the Shoalhaven Arts Board, Council and the community needs
o To fundraise and develop a sustainable principal investment to generate ongoing grant funds.
Relevant staff will work collaboratively with the Shoalhaven Arts Board to:
· Develop and implement activities to achieve objectives in line with the Shoalhaven Arts Board recommendations, the Council’s policies and corporate plan.

Nominations for the role of Chairperson were sought. Mr Stephen Buzacott was nominated for the position of Chairperson. Mr Buzacott accepted the nomination, and noting that no further nominations were received Mr Buzacott was declared the Chairperson.

AB23.4 Management of the Birkett Weatherhead Gift |

Ms Bronwyn Coulston – Manager Arts & Culture – provided some background to the Committee regarding how the works had been gifted to Council, and expressed concerns that the recommendation below doesn’t give Council the opportunity to fully realise the potential of the gift. An amended recommendation has been drafted below. Mr Stephen Buzacott requested that the Arts Board be able to view the works in person to allow for the Board to make a more informed decision about the retention and selling of the works. Council staff advised that an in person viewing can be facilitated for the Arts Board. |

Recommendation That the Shoalhaven Arts Board: 1. Endorse the advice of the Art Acquisition and Collection Subcommittee and submit to Council for adoption. 2. Retain the works by artists other than Jim Birkett listed in Table A (Attachment 1) in accordance with the Deed of Gift. 3. Retain the works by Jim Birkett listed in Table C (Attachment 3) in accordance with the Deed of Gift. 4. Sell the works by artists other than Jim Birkett listed in Table B (Attachment 2) in accordance with the Deed of Gift. 5. AB23.6 Shoalhaven Arts Board - The Way Forward |

Council staff advised that Advisory Boards and Committees of Council are becoming custodians of adopted Council Plans rather than having their own standalone strategic plan. This ensures it aligns with Council’s Community Strategic Planning and Reporting Framework. It was suggested that the Shoalhaven Arts Board consider and develop strategic priorities and goals that aim to align more with those set out in Council’s Advocacy Projects 2023. Council staff further advised that Council’s Delivery Program Operational Plan (DPOP) will soon be going on public exhibition, and as a part of the community consultation process, the Board can collectively mail a submission and provide their feedback and input to the DPOP process. Regarding point four (4) of the recommendation, Council staff noted that there is a significant conflict of interest due to Mr Drew Longbottom being a facilitator of the Dharawal Cultural Tour and a member of the Arts Board. Mr Clive Freeman noted that having two (2) traditional owner family representatives on the Arts Board brings an inherent level of indigenous cultural competency, without the necessity of the Board having to attend indigenous cultural activities. Clr Tonia Gray further noted that in future an invitation to the cultural immersion training which Councillors undergo could be considered by the Board members. |

Recommendation That Council: 1. Cover the cost of a professional facilitator to work with the Arts Board to develop and deliver a 5 year strategic plan 2023-2027. 2. Cover the cost of a professional facilitator to lead a series of public meetings with the arts community of the Shoalhaven. 3. Provide appropriate venues for public meetings with the arts community of the Shoalhaven. 4. Cover the cost of up to 8 members of the SAB to undertake the Dharawal Cultural Tour of the South Coast, to a maximum expenditure of $1200. 5. Consult the Arts Board with regard to the design of the new City entry at Nowra Bridge. |

Consider covering the cost of up to 8 members of the SAB to undertake appropriate first nations Cultural activities. The administration of any costs associated with undertaking cultural awareness first nations activities be administered by the CEO under delegation 5. Request staff to investigate how consultation is being undertaken by the NSW State Government and provide advice on how the Arts Board can provide feedback with regard to the design of the new City entry at Nowra Bridge. Carla Jackett - Wings - Exhibition Development - $1,250. 2. Sense of Place Grants a. Active and Effective - Climate Changed Women of the Shoalhaven – podcast series and printed calendar - $7,880. b. Blue Prints – resilience project including storytelling, installations and workshops - $10,000. c. Shoalhaven Songwriters Collective – song writing, recording and album release - $10,000. d. Connecting Community Through Art - 100 Years of Service - public art mural -$6,917. 3. The above recommendations will see the 2022/2023 Shoalhaven Arts Board Grants fund of $42,997 fully dispersed. A sum of $950 from the grant funds was expended on publicising and promoting the grants. This left $42,047 available to the evaluation panel when considering the 34 applications.

AB23.9 Addtional Item - Sub-Committee Meeting Review Guidelines |
Kate Dezarnaulds raised a concern regarding the current grants application process, which she felt was quite onerous for applicants, and perhaps unduly complicated. It was suggested that The Arts Board Grants Sub Committee review the guidelines and timeframe prior to the grants being advertised next year to see if this could be simplified and best practice applied.
Christine Dunstan appreciated Kate’s concerns however she felt that the grant process for applicants could be reviewed as professional development for artists, as this was a regular requirement for practising artists to access funding. |

Clr Tonia Gray suggested a recommendation to invite the Chair of the South Coast RADO to the upcoming meeting in June for a 10 minute presentation on who they are and what they are currently working on.

Background
Statistics:
The third quarter of the 2022-2023 fiscal year (January, February, March) Shoalhaven Libraries had over 84,000 people visit and nearly 82,000 items were borrowed. During this time the library also welcomed 748 new members.
Library staff answered more than 5,400 requests for general, reference and local studies information and additionally answered over 4,890 requests for help with technology. Our digital library loaned almost 28,000 items including eBooks, eAudiobooks and eMagazines.

During this quarter we celebrated:

· Tech Savvy Seniors Classes
· Harmony Week Storytimes at Nowra, Sanctuary Point and Ulladulla Libraries
· Seniors Week
A broad range of programs were available to celebrate Senior’s week – including a chronic pain talk and sessions about drugs, alcohol and wellbeing. Shoalcoast Community Legal Centre Inc. held legal information sessions on planning ahead and elder abuse at Nowra and Sanctuary Point Libraries, and an Intergenerational Storytime was held where children could bring along a grandparent or senior carer to a Storytime session.
Harmony week was celebrated across our libraries, with storytimes for 2–5-year-olds, at Nowra, Sanctuary Point and Ulladulla Libraries. There were stories, rhymes, music and craft, and kids had the opportunity to decorate Harmony Trees with their own paper hand and wear the colour orange to show their support.
A very fun Magical afternoon was held at all branches to celebrate Harry Potter Afternoon. Attendees dressed up for the afternoon and made dragon eggs, played Pin the Nose on Voldemort, had Professor Trelawney read their tea leaves, discovered their Harry Potter names and much more.
March also saw Shoalhaven Libraries launch an exciting new initiative called The Book Bar. The Book Bar has multiple titles of popular and new releases available to borrow so customers aren’t waiting too long to read the books they want. Items are available on a two-week loan, with no holds and no renewals, with titles being continually added to the Book Bar collection.
Author Talks:
We continue to promote local authors, fostering a love of books and literacy in the community by hosting talks and book launches from a range of authors.
Bill ‘Swampy’ Marsh launched his new title, ‘Great Australian Stories’ at Nowra and Ulladulla Libraries. ‘Swampy’ has a deep affection and respect for the people living in the Australian Bush and he’s spent more than 20 years travelling to every corner of the country, talking to people from all walks of life, collecting their memories and stories, which he shared with the Shoalhaven community.
Our Local Heritage Librarian, Megan Crook, launched Alan Clark’s latest book ‘Delivering the News’ at the Nowra Museum with more than 40 people in attendance, including descendants of people featured in the book. Megan presented an excellent speech where she recounted her connection to the book and that of her family to the local area. Megan spoke of Alan’s outstanding contribution to research, authoring more than sixty publications on our local history. With his relentless attention to accuracy, Alan not only extracts his stories from a wide variety of sources but also devotes his skills to seeking out descendants to flesh out his characters into real people.
Online Assistance:
Digital assistance and training continue to be a focus for Shoalhaven Libraries as we receive many requests for help and support. Libraries play a vital role in helping people become digital citizens by providing access to technology and lifelong learning.
During February and March Tech Savvy Seniors classes were held offering a range of classes for our senior community. Sessions ranged from an Introduction to Social Media, Introduction to Online Shopping, Introduction to Cyber Safety to Managing your Digital Assets. These sessions were made available following the receipt of grant funding, managed by the State Library of NSW, from the NSW Government and Telstra.
A change in day to Wednesday for our weekly Tech drop in sessions has proven popular. Sessions are fifteen to thirty minutes long, no bookings are required and there is no cost to attend a session. In addition an NBN representative is available for the first session of the month to provide additional information and support.
Safer Internet Day 2023 was held in February. Shoalhaven Libraries supported this initiative with free webinars available on different topics such as eSafety 101, Setting your child up for success online, Getting the most out of Gaming and Navigating online Friendships.
Local Heritage:
Our local heritage room featured a display, courtesy of the Shoalhaven Historical Society, on the Nowra Bridge. The display focused on the social aspects of the first bridge’s opening in 1881 and how that event completely changed the fortunes of Nowra, the status of the bridge as a tourist attraction, and described how it eventually became one of the town’s major icons.
Our Flashback Friday posts continue to be very popular on our FaceBook page. This quarter we reminisced about The Nowra Show and old real estate maps in the Jervis Bay area.
Other Public Programmes:
Ulladulla Library has been holding lots of free fun events. A ‘Found Poetry’ afternoon was held, which was an easy, fun and creative session, and no writing skills were required. ‘Get Creative @ Ulladulla Library’ is held monthly where attendees enjoy a casual chat and a cuppa whilst creating beautiful works of varied crafts such as lanterns, cards, snowflakes, mobiles. And finally artist Glenn Kilby from Millhouse Art Gallery held a free 7-week Portrait Demonstration workshop, where participants enjoyed the opportunity to sketch their own portraits and learn new techniques.
School holiday activities were held during January. Kids had the opportunity to create beautiful pencil cases at Nowra and Sanctuary Point Libraries, and a ‘Just Write’ screenwriting workshop was held at Ulladulla Library with Morna Seres. This was a 3-hour workshop where the focus was on fiction screenwriting and explored the character, structure, writing visually and crafting dialogue. A STEAM event was also held at Ulladulla Library where participants had a great time experimenting with spheros, which are app-controlled robots which foster basic computer science skills through play-based learning.
Earth Hour was celebrated on 25th March. At 8.30pm we were encouraged to switch off our lights for an hour and take #TimeOutForNature to reflect on the benefits nature provides us and join the global community supporting stronger action to change. A free Energy bill buster workshop was held to celebrate Earth Hour, and attendees learnt how to save money, reduce energy, and make their home more comfortable.
New Sanctuary Point Library Public Art:
The successful artists selected for the three public art opportunities at the new Sanctuary Point Library continue to work on their submissions with the architects and industrial design company. All the projects are progressing well and are on track to have their detailed designs completed to fit with the construction tender process.

Background
Shoalhaven Entertainment Centre has experienced a busy period since reopening its theatres and rooms for hire in March following compliance works. During 12 days in May the venue welcomed more than 5,300 people into the theatres. A total of 4,433 of those were ticketholders. In support of those events’ venue staff prepared and served more than 640 two and three course a la carte meals and 900 morning and afternoon teas, in addition to food and beverages served at Encore Café and Bar.
2023 Season Update
Karin Schaupp (pictured) and the Flinders Quartet performed a well-received concert in the Auditorium on Friday March 3. The programme included a guitar concerto by Ferdinando Carulli, Southern Cross Dreaming by Australian composer Richard Charlton, a quintet by Mario Castelnuovo-Tedesco, Endless a new work commissioned by Musica Viva for guitar and string quartet by Carl Vine, Phantasy Quartet by Imogen Holst, and a guitar quintet by Luigi Boccherini.

Created by Yaron Lifschitz with the Circa Ensemble, this production proceeded despite a key performer being injured the evening before the company’s performance with a substitute artist being flown in to join the tour at short notice.
The production, pictured above, attracted an audience across a broad age spectrum.

Roald Dahl’s The Twits
Gruesome twosome, The Twits, received a rockstar reception at the sell-out school’s performance on Wednesday, May 24, and attracted a strong house for the family show at 6pm. With high production values, inventive staging, and funny pranks children, teenagers, parents, and grandparents audibly delighted in the production.

Cilla – You’re My World – Morning Matinee
More than 600 people attended the performance showcasing the powerhouse vocals of one of Britain’s best-loved performers Cilla Black on Wednesday, June 7.

Local Government Excellence Awards:
Shoalhaven Entertainment Centre and Shoalhaven Regional Gallery were finalists in the NSW Local Government Excellence Awards held in Sydney on June 1 for Shoalhaven: Let’s Celebrate, Create and Laugh.
This series of low-cost or free engagements were funded by a grant from the NSW State Government’s Reconnecting Regional New South Wales. The events delivered late last year included the two-day South Coast Country at the Entertainment centre, Casey Donovan Reconnects Live in Concert at the Entertainment Centre, Multicultural Comedy Gala at the Ulladulla Civic Centre, Live and Local Microfestival acts performed at Jelly Bean Park in Nowra; and the mini-festival and public art workshops in connection with the Plant Your Feet exhibition at Nowra Regional Gallery.

Reason for Report
The purpose of this report is to present the Shoalhaven Arts Board (SAB) with the new Terms of Reference (ToR) template and to organise a workshop with SAB members to review and provide feedback on the proposed changes.

Implications: The new ToR will be reviewed at a workshop and allow all members of the Shoalhaven Arts Board to participate in the review.

Implications: The proposed ToR will not be updated and the SAB will be required to provide an alternative proposal.
Background
Committees are overseen by various teams and directorates across council. When reviewing the six advisory committees that are overseen by staff in the City Lifestyles directorate it was identified that there was an opportunity for greater consistency in the ToR documents for these committees.
In response, a new Terms of Reference Template for advisory committees has been developed and endorsed. The use of this template will ensure improved consistency across council’s advisory committees in how they undertake their functions. The introduction of the template has commenced in the City Lifestyles directorate and it is anticipated that this format will be rolled out across the other directorates.
The template provides a format to clarify and assist in managing expectations around advisory committees and their roles. This will assist the members in understanding and carrying out their roles and functions of the advisory committee and any delegation therein.
Please find attached the SAB current ToR and also a copy of the updated ToR template for your information.
It is proposed that a workshop is held with the SAB members to review the proposed ToR and provide feedback on its modification, Governance will attend this workshop to provide guidance and advice to the group. Once the workshop has been held and the new ToR document has been updated a report will be submitted to the next SAB Meeting for members to review and endorse.

Community Engagement
Members of the SAB will be consulted at the workshop. Governance will be consulted to ensure the edits are commensurate with policy and guidelines.

Background
Shoalhaven Regional Gallery has delivered a wide range of exhibition and activities in the period from February – April 2023.
Exhibitions
Spanning across the East, Access and Foyer galleries from 4 - 25 February 2023 was the New Horizons exhibition, showcasing the HSC Visual Arts body of works produced by Year 12 students from local high schools from Kiama to Ulladulla. There was a diverse range of themes and media – from self-image and social issues facing teens, to cultural heritage and family connections.
Also running through February, and coinciding with Sydney World Pride, the Gallery held Man About The House in the Main Gallery. ‘Man About The House: A Series of Mundane Postcards’ were created by the late Melbourne artist Robert Pearce during the early 1980s. The works present frivolous collaged images of hyper-masculine, scantily clad men and tongue-in-cheek text into domiciliary, “traditionally feminine" domains, upending and re-defining heteronormative gender roles and honouring Queer identity. Shoalhaven LGBTQIA+ and invited artists were invited to respond to these postcards informed by their own practice, touching on the themes and aesthetic of Pearce’s work.
March welcomed two dynamic exhibitions, with Jerrinja Balaang and Groundswell: Recent movements within art and territory running from 4 March – 22 April. The beautiful photographic work in Jerrinja Balaang depicted aspects of balaang (women’s) life, traditional Aboriginal language and cultural connections to their own Jerrinja Wandi Wandian Country. Elders and Aunties from the Jerrinja Local Aboriginal Land Council and community guided the artists throughout the journey. Creative photography, editing and curation was guided by award winning photographic artist and mentor Tamara Dean and producer Alex McNeilly from Southland Creative Inc.
Alongside scientists and environmentalists, artists have historically presented as some of the first responders to this crisis, bearing witness to its effects through creative expression. Groundswell: Recent movements within art and territory showcased a selection of powerful reactions with particular focus on creeping changes to the Northern Territory’s water supply. It charts these changes by grouping artistic responses thematically into the prevailing resource issues of Access, Contamination, Scarcity and Culture. Diverse in aesthetic but united in unambiguous concern for Country, Groundswell showcased works of formidable creativity and tangible substance.

In the art boxes we have exhibited two different artists during this period, with John Havilah currently having a mini exhibition that spans across the Art Boxes and the Mayor’s office. This extension of our exhibition program has been very positively received with artists needing a much smaller body of work and the boxes having a simpler application process.

The Gallery continues to deliver a wide range of public programs and events to many different audiences. Our Art After School program for children from 5-18 continues to be very popular, and our new Drawing in the Gallery program is developing a loyal following. Our schools program continues to grow with a recent visit by Kangaroo Valley Public School and several enquiries for Term 3 delivery being received in recent weeks.
Grants update
The Arts and Culture Department continue to apply for and receive funding for a range of activities.
Current Grant submissions:
· ‘Create NSW Annual Organisation Round 2’ – unsuccessful.
Funding was sought for Our Place: Your Story, supporting two major arts projects to be delivered in 2024: an art/research project by Chinese Australian artist Tianli Zu and Age of the Anthropocene curated by First Nations curators exploring the lived experiences of changing climates along major river systems across the east coast and how First Nations knowledge can assist with understanding the changes.
· ‘Create NSW Multi-Year Funding Arts and Cultural Organisations’ EOI for 24/25 – awaiting determination.
Our Place: Your Story exhibition series will see Shoalhaven Regional Gallery commission one major exhibition per year and support an artist to research and develop an exhibition responding to a relevant theme.
· ‘Australia Council Digital Specialist in Residence’ – awaiting determination.
This program funds the mentoring of small / medium arts organisations by a digital specialist to support upskilling, increased knowledge and development of a digital project.
Awards and Recognition
Shoalhaven Regional Gallery received a Highly Commended Award at the Museums Australasia Multimedia and Publication Design Awards for the category Exhibition Catalogue (Small).
The Gallery was also part of the Shoalhaven Let’s Celebrate project which was shortlisted at the 2023 Local Government Excellences Awards in the Special Project Initiative category.
Current / Coming Up
April ended with a bang, a beer and a band! The National Portrait Gallery of Australia’s touring photographic exhibition Pub Rock opened with a live band in the Main Gallery covering some classic Australian rock anthems, the crowd singing along.
Running concurrently, The Mental Health Fellowship Open Art Competition opened with the awards ceremony for First, Second, Third Prizes and the Black Cockatoo Encouragement Award – donated generously by Warwick Keen.
Ecuadorian-born, Australian multi-disciplinary contemporary artist Mariana del Castillo’s beautiful exhibition Quiet – Unquiet showcases her textile and sculptural driven practice after a residency at Bundanon. Exploring concepts of regeneration in nature.
These exhibitions opened 29 April and will continue to 24 June.

The Gallery will open two new exhibitions 1 July 2023. These exhibitions are the annual Creative Moments show and Interconnected. Creative Moments brings together the works by members of the Shoalhaven Woodcraft Society, Nowra Spinners and Weavers and Shoalhaven Potters. This year the theme is Twists, Turns & Angles. In Interconnected four south coast artists present their personal and creative responses to the natural ecologies of the region across painting, drawing, collage and sound. The official opening for these exhibitions will be at 2pm on 1 July. All are invited to attend.

Reason for Report
The reason for this report is to inform the Shoalhaven Arts Board of the recommendations made by the Art Acquisition and Collection Subcommittee as to which items in the Birkett Weatherhead Collection should remain in the Shoalhaven City Art Collection and which should be sold to fund the care, storage, and exhibition of said collection, as per the terms of the Gift.
Options
1. Accept the Recommendation.
Implications: Council will be able to sell works that do not meet the requirements of the Shoalhaven City Council Art Collection – Acquisition and Collection Management Policy POL18/23 and use these funds to look after remaining works.
2. Amend the Recommendation.
Implications: Unknown at this time.
3. Reject the Recommendation.
Implications: The works that do not meet the requirements of the Shoalhaven City Art Collection will remain in the Shoalhaven City Art Collection and will require ongoing investment in storage and conservation.
Background
In 2020, local philanthropists and collectors, Jim Birkett and Roy Weatherhead, gifted more than 200 works to the Shoalhaven City Art Collection, with a Deed of Gift signed by Council and Jim Birkett on 11 May 2020.
Suggestions for the management of this gift were presented to the Arts Board on 8 March 2023 (item AB23.4) and the Ordinary meeting on 3 April 2023. The adopted resolution (MIN23.170) noted that:
That Council:
1. Endorse the advice of the Art Acquisition and Collection Subcommittee.
a. To retain the works by Jim Birkett as listed in Table C (Attachment 3) in accordance with the Deed of Gift.
b. To sell the works by Jim Birkett as listed in Table D (Attachment 4) in accordance with the Deed of Gift.
2. Defer making a decision on the works by artists other than Jim Birkett.
a. Requesting Staff and the Art Acquisition Subcommittee to reconvene to give further consideration to the works by other artists (Table A - Attachment 1 and Table B - Attachment 2).
b. Provision of advice to the Arts Board on which works to retain and which works to sell in accordance with the Deed of Gift and report back to a future meeting of the Shoalhaven Arts Board.
3. Note that the funds received from the sale of works in part 1.b will be put into a dedicated Council Reserve and used explicitly for the purpose of the care, storage and exhibition of works retained in the Birkett Weatherhead collection as per the terms of the Birkett Weatherhead Gift.
4. Inform Roy Weatherhead of the outcome of decision made in part 1.
This report provides the request advice based on a reconvening of the Art Acquisition and Collection Subcommittee as noted in part 2a and 2b of that resolution.
Recommendations of the Art Acquisition and Collection Subcommittee
Two members of the Art Acquisition and Collection Subcommittee: Bonnie Porter Greene and Boe-lin Bastian, met with Gallery staff; Bronwyn Coulston, Manager – Arts and Culture and Bridget Macleod, Gallery Officer, on 25 May 2023 to reconsider the previous recommendation on works by other artists. Apologies for this meeting were received from Christine Dunstan and Stephen Buzacott.
The members of the subcommittee and staff viewed many of the works to be considered, and reassessed the relationship of those works to the rest of the collection; considering potential exhibition and research opportunities, connections to works already in the collection and opportunities to connect to living artists.
The subcommittee have proposed a new recommendation for consideration with works to be retained in Table A, works to be sold in Table B and works which should be held until the remainder of the collection is received by the gallery and further research can take place in Table C. The works to be retained include a new category of works for archival purposes. These works are those which provide context to the story of the collectors and their relationships with various artists. Precedence for an archival collection has been set with the Dingle Hughes Collection.
Community Engagement
The process to formally acquire or sell works in the collection will be undertaken with public knowledge of the process and the reasons behind it. This report and the attachments form part of that awareness. The Birkett Weatherhead Collection will form part of the Shoalhaven City Art Collection and be accessible through the online collection database, exhibitions and programs.
While the Deed of Gift has no explicit requirement for Council to continue to engage with the donor, as a matter of courtesy Council staff will continue to keep Roy Weatherhead informed on the process being undertaken and any decisions made.
While the Deed of Gift has no explicit requirement for Council to engage with living artists whose works are included in the Collection, as a matter of courtesy Council staff will (as far as is reasonably practical) inform those whose works will be sold and the reasons for this once a determination is made.
Policy Implications
The works in Tables A and B (Attachments 1 and 2) have been assessed against Shoalhaven City Council Art Collection – Acquisition and Collection Management Policy.
Financial Implications
In accordance with the Deed of Gift, all sales from Part 3 of the Collection must take place through reputable auction houses with the best possible price achieved and will be for the sole purpose of maintaining the remainder of the Gift. Funds will go into a separate reserve to ensure they can only be used for the explicit purpose of managing the Birkett Weatherhead Collection.
The sale of the proposed works listed in Tables B and D (Attachments 2 and 4) will:
· Allow for the ongoing preservation and care of the Collection.
· Ensure that works retained and insured as part of the overall Collection are commensurate with Shoalhaven City Council Art Collection – Acquisition and Collection Management Policy.
· Ensure that Collection storage needs are prioritised and focuses on items which are commensurate with Shoalhaven City Council Art Collection – Acquisition and Collection Management Policy.
Any ongoing costs associated with care, preservation and management of the Birkett Weatherhead Collection will be funded from the Birkett Weatherhead Art Collection Reserve when established.
Risk Implications
There is reputational risk if works in Table B (Attachments 2) are sold without previously consulting with both living artists of these works and the living donor, Roy Weatherhead. Correct consultation will be followed to mitigate this risk.
The sale of any works shall take place through reputable auction houses with the best possible price achieved, ensuring the reputation of the Gift and the Collection is maintained.

Background
Several offers of work for the Shoalhaven City Art Collection have been received in the last quarter. These works and the recommendations of the Art Acquisition subcommittee are noted below.
1. Offer of work for donation through the Cultural Gifts Program by Lisa Havilah and Pip Havilah
Lisa and Pip Havilah have a long-standing connection to the Shoalhaven. They are offering a painted work by Ruben Ernest (Ben) Brown for acquisition through the Cultural Gifts Program. This work was gifted to their mother who was an arts teacher at TAFE and taught art to Ben Brown.
This work is by a local first nations artist and will significantly enhance our holding of works related to makers of the region. The City Art Collection has one other work by Brown, which formed part of a previous gift from Havilah. Bundanon Art Museum recently held a survey show of works by Brown as part of their Parallel Landscapes season in 2022.

2. Offer of work for donation by Lisa Havilah and Glenn Barkley
Lisa and Glenn have a long-standing connection to the Shoalhaven and the NSW arts and cultural sector. They are offering a pair of shellwork slippers by Esme Timbery for donation.
This work is by a Southern Sydney / South Coast first nations artist and will significantly enhance our holding of works related to makers of the region. Works by Timbery are held in state and national collections, and she is noted as one of Australia’s most significant shell artists.

3. Offer of work for donation by Lynne Wiltshire
We have had an offer of donation of the below work, painted by Averil Muller in 1986. The gallery already holds a work by this artist Danjera Gorge, 1970. Muller exhibited in local art shows and competitions across the region, with finely executed landscapes as the main focus of the works.
The committee are not recommending this work as it has a similar subject matter to many works in the collection - for example works by Leonard Long, John Sharman, Terry Webber and Samuel Elyard that are similar in subject matter and composition. This work is not seen to add anything new or be of outstanding artistic merit to warrant adding to the collection.
The proposed acquisition meets the criteria of the Shoalhaven City Council Art Collection under section 3.1.6 under the following considerations:

4. Purchase of prints by Robert Dickerson
Robert Dickerson is one of Australia’s most recognised figurative artists. His works comment on aspects of the human condition. He was a member of the 1959 Antipodeans group and is represented in all major state and regional collections. Dickerson lived in the Shoalhaven for many years, prior to his death in 2015.
The Dickerson Gallery has offered to work with the Shoalhaven City Art Collection and develop a group of 5-10 prints from Dickerson’s archives that would be made available for a price of $5,000. This represents a significant reduction in costs for works and will ensure the City Art Collection can acquire a good range of works by this significant local artist.
The Art Acquisition subcommittee recommend the acquisition of prints by Dickerson noting that it meets the criteria of the Shoalhaven City Council Art Collection under section 3.1.6 under the following considerations:

· Advantageous opportunities
Once a listing of possible works has been received from the Dickerson Gallery, the Manager, Arts and Culture will work with the Art Acquisition subcommittee to identify which works from the listing would be suitable for acquisition into the collection.
Community Engagement
The City Art Collection is made available to the community through the online collection catalogue, through exhibitions at Shoalhaven Regional Gallery and through placement of suitable works in the Administration building, Shoalhaven Entertainment Centre foyer and other locations as suitable.
Policy Implications
All offers of work for acquisition were reviewed against the Shoalhaven City Art Collection – Acquisition and Management policy.
Financial Implications
The Art Acquisition budget has sufficient funds to cover the cost of purchasing prints by Robert Dickerson should the Board decide to proceed with the acquisition.
The Acquisition budget for 2022/23 is $6,000 with no expenditure to date. The Acquisition budget for 2023/24 is currently set at $6,000.

Background
At the Ordinary meeting of 22 May 2023 Shoalhaven City Council were presented with a report outlining the way forward for the establishment of the Shoalhaven Arts Foundation (Attachment 1).
Council have been working with J9 consulting to develop an appropriate draft constitution for the Arts Foundation, an overview of which was presented to Councillors at a briefing on 2 February 2023. A number of matters were raised at this briefing, and following a period of further revisions and due diligence, it was noted that the revisions to enhance council’s role as the Founding Member would trigger a requirement to seek consent from the Minister for Local Government to form the Foundation in accordance with section 358 of the Local Government Act 1993. Section 358 of the Act relates to restrictions on council’s forming corporations or other entities.
As per the attached minute (MIN23.272 – Attachment 2), Council have re-affirmed their commitment to the establishment of the Shoalhaven Arts Foundation and have agreed to receive a further report seeking approval to make application to the Minister. This report will contain the draft application and all necessary documentation for review.
Community Engagement
The proposal for the formation of the Shoalhaven Arts Foundation is based on feedback from a series of community consultations over a period of more than 4 years. A significant desire for the Foundation to progress, and a clear understanding of the potential benefits to the region are articulated in the feedback received to date.
Policy Implications
The establishment of the Shoalhaven Arts Foundations would meet Council’s policy objectives in bringing the arts to the Shoalhaven region. Its establishment is linked to the goals of Council’s Delivery Program, while meeting required standards of governance.
Financial Implications
As resolved by Council on 26 April 2022, as part of the 2022/23 budget preparations, funding was allocated to the establishment of the Shoalhaven Arts Foundation for three years, being $150,000 in 2022/23, $150,000 in 2023/24 and $100,000 in 2024/25.
Risk Implications
As the Shoalhaven Arts Foundation is to operate independent of Council, including employment of its own staff, it will have minimal risk to Council. Council’s costs to meet its establishment over three years are not considered significant and are rated as low risk.

Background
Across the Financial Years of 2020/21 and 2021/22 the Shoalhaven Arts Board have funded 13 grants to a total value of $58,740, supporting a variety of projects under both the ‘Professional Development’ stream and the ‘Sense of Place’ project-based grants. Many of these projects were impacted and delayed as a result of COVID and extreme weather events. The following report provides acquittals for the final projects from these two rounds.
Projects completed and acquitted:
1) Albatross Musical Theatre Company - $3,000
Five members of the Company were able to attend a variety of courses in person and through Zoom. Skills gained included production, lighting techniques and design, and technical skills.
2) Shoalhaven Youth Orchestra – South Coast Sketches - $10,000
The Youth Orchestra commissioned Ryley Gillen to compose a series of short pieces to form a new suite ‘South Coast Sketches’. The work was premiered in December with CDs also available.
3) Alaska Turner – Backstage theatre skills - $3,000
Alaska was able to undertake an internship in backstage theatre skills and is now looking at options for tertiary education in this field.
Community Engagement
The Arts Board grants are available to all artists and arts groups within the Shoalhaven. They are advertised annually and applications are assessed by members of the Arts Board.
Financial Implications
All funding for Arts Board grants has been made available and allocated. There are no financial implications to the variation request sought. All grant acquittals show that the money was spent as approved and no additional funding was requested from Council.
