Purpose

To provide appropriate and considered advice to Council on all relevant issues affecting Aboriginal and Torres Strait Islander people within the Shoalhaven LGA, and to influence Council’s support & intent in achieving their objectives for the current Statement of Commitment 2010 (SoC) and the Shoalhaven City Council Community Strategic Plan 2023 (SCCSP).

 

Role of the Committee

·           To advise Shoalhaven City Council on necessary issues relating to Aboriginal communities in the LGA.

·           Promote and increase knowledge & understanding of Aboriginal society, history & culture in the LGA.

·           Facilitate access and accessibility to services and facilities for Aboriginal people.

·           Advise on the development and implementation of the Shoalhaven City Council Community Strategic Plan.

·           Develop strong collaborative partnerships between Aboriginal communities and Shoalhaven City Council.

·           Maintain strong links between Council and Aboriginal communities throughout the Shoalhaven to accomplish the relationships and outcomes required for genuine reconciliation.

·           Foster and safeguard a spirit of mutual trust and respect which allows the AAC and Shoalhaven City Council to work together in their commitment towards intelligent, well informed decision making processes that are sensitive to all Aboriginal issues.

·           Recognise, support & uphold past and present local cultural heritage and its place in future Council directions.

·           Remain a meaningful ‘place’ for the communication of messages and information from Aboriginal community voices that identify local needs for services, facilities and activities.

·           Support and promote significant celebrations and events within the Shoalhaven Aboriginal and Torres Strait Islander community.

STATEMENT OF COMMITMENT

 

This Statement commits Shoalhaven City Council to continue building mutually respectful relationships with the Aboriginal Communities of the Shoalhaven.

 

Shoalhaven City Council values its culturally diverse communities and lifestyles and is deeply committed to working in partnership with Aboriginal people of the Shoalhaven. This Partnership will be based on mutual respect and equality to further employment, social, cultural and economic community development.

 

Shoalhaven City Council recognizes and acknowledges the history and treatment of Aboriginal people in Australia and supports the Council for Aboriginal Reconciliation’s vision and values.

 

Shoalhaven City Council recognises Aboriginal people’s valuable contribution made in strengthening and enriching our communities and the heritage of all Australians.

 

Shoalhaven City Council Acknowledges and Recognises:

·         Aboriginal people as the first people of Australia

·         Past practices and policies that impacted on Aboriginal people’s lives, cultures and society

·         The customs and traditions of Aboriginal people and their spiritual relationship with the land

·         The rights of Aboriginal people to live according to their own beliefs, values and customs, and

·         The significant contribution made by Aboriginal people in the past, present and future.

 

Shoalhaven City Council commits itself to:

·         Ensuring local Aboriginal involvement in events and celebrations of significance which respect the dignity and protocols of the local Aboriginal communities

·         The ongoing development of strategies to improve and increase the level of participation of local Aboriginal people in the local Government decision making processes

·         Undertake holistic community planning to address wellbeing, employment and social economic or cultural disadvantage experienced by local Aboriginal people in the Shoalhaven

·         Ensuring all council staff and Councillors are exposed to ongoing education and cultural training and development programs to increase knowledge, understanding and appreciation of Aboriginal Cultural heritage and the needs of the Aboriginal communities

·         Celebrate and support significant Aboriginal ceremonies and events, e.g. NAIDOC week, Sorry Day, Reconciliation Week and Survival Day

·         To continue to fly the Aboriginal flag in places such as City Administrative Centre, Council Chambers, Reception room and in other prominent Council locations.

Presentations

 

AA21.10     Presentation - Clontarf Academy

HPERM Ref: D21/200852

Staff and students from the Shoalhaven Contarf Academy and the Vincentia Clontarf Academy made a presentation to the Committee about the work that they do.

·     The Clontarf Foundation exists to improve the education, discipline, life skills, self-esteem and employment prospects of young Aboriginal and Torres Strait Islander men to equip them to participate more meaningfully in society.

·     The first academy opened for 25 boys in 2000 and has now grown to approximately 10,500 boys in 139 schools in six states across Australia.

·     Clontarf academies were established in 2019 at Shoalhaven and Vincentia High Schools. In 2021 there are 77 participants at Shoalhaven High and 102 participants at Vincentia High.

·     The five learning areas the Academy focus on are:

Leadership

Well-being

Employment

Sport

·     Camps are held each term to reward those participants who have met the set criteria - for example good attendance rates, positive behaviour, completing school work so that the boys can earn their way to attend the camps.

·     A main focus of the Academies is leadership where public speaking is encouraged and opportunities are provided for the boys to speak to different groups and different venues to build confidence in public speaking.

 

AA21.12     Bushfire Recovery Plan - Coastal Waterways

Neal Albert – Alluvium, gave a presentation to the Committee outlining the South East Catchments and Waterways Bushfire Recovery Plan and the need to work with Local Aboriginal Land Councils in the affected areas as part of the development process.

It was agreed between the Committee and Alluvium that Alluvium would liaise with the CEOs of the LALCs when the Plan is being implemented.

AA21.6       Consideration of Membership - Ron Carberry

HPERM Ref: D21/74509

Alfred Wellington – CEO of Jerrinja Local Aboriginal Land Council, declared a Conflict of Interest – abstained from voting.

Natalie Lloyd - Jerrinja Local Aboriginal Land Council, declared a Conflict of Interest – abstained from voting.

 

Nicole Moore noted that this application had been discussed at the Committee meeting held on 7 December 2020 and at that time it was deemed that the applicant did not meet the selection criteria and the application was not approved.

If this application is successful, the appointment of Ron Carberry would mean that the Terms of Reference will need to be amended to increase the Community Membership of the Committee to 14 members.

It was suggested to defer the consideration of the application until after the Terms of Reference workshop.

Recommendation

That:

1.    The Aboriginal Advisory Committee consider recommending that Council appoints Ron Carberry as a community member on the Aboriginal Advisory Committee;

2.    Subject to Part 1 being adopted, Council amend the Terms of Reference and increase the Community Membership to 14 members.

AA21.7       Tourism Marketing Update

Coralie Bell – Tourism Manager, presented the draft Visitor Guide. The Committee expressed concern at the operators included in that list and their authority to practise culture on country.

The Committee asked that Council note the lack of consultation with members of the Committee in the development of the list.

It was agreed that members of the Committee work together with the Shoalhaven Tourism Advisory Group (STAG) on other tourism ideas members may have and provide feedback on future collaboration opportunities.

The Committee does not endorse the list of Indigenous tourism operators that has been included in the Draft Guide because the list could cause conflict with members of the Aboriginal communities who have more knowledge of country at these particular sites. The Committee asked that wording be included on the Guide to say “This is not an exhaustive list of Indigenous Operators” or “Some Indigenous Operators include” or something to that effect to make it clear that this is not a list fully endorsed by the Committee.

The Committee does not endorse the content of the Visitor Guide on the basis that a member cannot endorse on behalf of others and have requested that a cultural disclaimer be included on the Visitor Guide. This will be workshopped via email with the Tourism team and AAC members.

AA21.8       Aboriginal Advisory Committee Status Action Report

In relation to item AA19.18 - Plaques Identifying Culturally Significant Locations – Design and Costings:

·    It was noted that there are culturally significant locations in the Shoalhaven where no interpretive signage exists or has been placed.

·    Michael Paine Manager – Community Connections advised that plaques are to be placed at sites of cultural significance telling the story of the area and the Indigenous people and that the sign for the Greenwell Point reserve is currently being reviewed by Jerrinja LALC.

·    A Question on Notice was raised, asking whether a budget bid has been made for the Plan of Management for Council owned land at Cullunghutti for 2021-2022.

AA21.14     Rescission Motion - Huskisson Church

Nicole Moore provided the meeting with an update on the resolution at the Ordinary Meeting of Council held on 25 May 2021 to go ahead with the shallow scraping at the Former Anglican Church site at Huskisson and that a Rescission Motion was received on this Item.

That the Aboriginal Advisory Committee:

1.    Implore that Council consider the Rescission Motion on the shallow scraping at the Former Anglican Church site at Huskisson.

2.    Wholeheartedly support the Rescission Motion in respect of DE21.43 – Update – Planning Proposal PP050 – Former Anglican Church, Huskisson – Ground Penetrating Radar Survey.

Background

Shoalhaven City Council has committed funding towards a new District Library for the Bay and Basin area in Sanctuary Point. This new community facility will inject new life into the Sanctuary Point township by providing a hub of community activity; access to technology and information; a place for meeting, collaborating, connecting, studying; and access to business spaces, reader services and collections.

Extensive community consultation has taken place regarding the design of the building through workshops, external stakeholder groups, community groups and public exhibition. This has indicated that this new facility has very high levels of support by the community and that there is a desire to incorporate public art into the building, particularly art that is representative of the locational context and Aboriginal history of the area. This was a consistent theme throughout the community consultation and engagement stage.

The architects, Brewster Hjorth Architects, have identified various opportunities for public art within the library design (see Attachment 1) including:

·    Perforated Sunshades within the building design on the Kerry Street frontage

·    Landscaped green art wall (external)

·    Precast concrete wall mural within library

·    Internal and external directional signage and within elements of the furniture

The incorporation of public art is considered an integral part of the project and, as such, The National Association of Visual Artists (NAVA) best practice guidelines are being followed to inform the governance of this aspect. Council has committed to engage a Public Art Curator / Consultant – Indigenous to commission artist(s) to prepare artwork for the facility, and Council staff are currently working on documentation to engage a specialist in this field with the experience, skills, and ability to deliver a high-level result for this project. 

Once the Public Art Curator / Consultant - Indigenous is engaged an Expression of Interest will be run for artists to submit their designs and ideas for the new library building.  Based on the applications put forward, a selection of artists will be invited to further develop their proposals. From this a final shortlist of artist(s) will be selected.  

The artist(s), in collaboration with the appointed Public Art Curator / Consultant, BHA, Council and the community, would be commissioned to undertake the project, engaging in a range of consultations and development works to ensure the project is delivered to expectation and commensurate with community aspirations.

 

Community Engagement

The community have been consulted on the Sanctuary Point District Library project in a variety ways; in mid-2020 a Get Involved page was established for the project on Council’s website; Council undertook a survey to seek feedback on what design elements should be included in the design of the building, and what services should be provided within the building.

Further community engagement has been undertaken through a series of stakeholder and community workshops; an online survey, which was hosted on the Get Involved page, and the public exhibition of the concept design for the Sanctuary Point District Library was undertaken in April 2021.

At the conclusion of the community consultation and public exhibition phase a report was provided to Council outlining the comments received, proposed changes and the concept design was adopted. Further consultation will be undertaken after the DA is lodged and Council will continue to consult with the community regarding this important community building.

AA21.16     Aboriginal Advisory Committee Terms of Reference Review

Reason for Report

To provide the Aboriginal Advisory Committee with proposed amendments to the Terms of Reference for endorsement.

Recommendation

That Aboriginal Advisory Committee accept the proposed amendments to the Aboriginal Advisory Committee Terms of Reference and submit to Council for adoption.

 

 

Options

1.    The recommendation is adopted as written:

Implications: The Terms of Reference (TOR) will be updated and provide the Aboriginal Advisory (AAC) an agreed way forward as detailed in this report.

 

2.    The recommendation is not adopted, and an alternative recommendation is provided.

Implications: The proposed TOR will not be updated and the AAC will be required to provide an alternative proposal.

 

Background

The Aboriginal Advisory Committee (AAC) review workshop was held on Monday, 6 September 2021. Four members of the AAC attended the workshop to review the Terms of Reference (TOR) and have suggested the below amendments for the group to review and endorse. Following the TOR workshop, Governance were consulted to review the proposal and some adjustments have been suggested which are outlined below.

AAC proposed amendments are as follows:General

·    Update Council staff titles reflecting the organisational restructure.

·    Update Council’s Community Strategic Plan to reflect most recent from 2023 to 2027

1. Purpose

·    Include reference to Council’s endorsement of the Uluru Statement of the Heart 2020.

4.2 Role of the Advisory Committee

·    Addition Provide specialist advice to others of Council’.

4.3 Membership

·    Suggested amendment ‘Five (5) members being a representative from each Local Aboriginal Land Council which include Nowra, Jerrinja, Ulladulla, Illawarra and Batemans Bay’

This currently reads that membership covers delegates from three Local Aboriginal Land Councils (LALCs) Nowra, Jerrinja and Ulladulla. It is proposed that this be amended to extend to the five Local Aboriginal Land Councils (LALCs) and include Illawarra and Batemans Bay as these LALCs overlap the land footprint of the Shoalhaven LGA.

·    Remove organisation / agency list to broaden out and include all Aboriginal organisations and agencies in the Shoalhaven which the AAC can approach to provide professional guidance.

AAC members indicated that 13 local Aboriginal community representatives are sufficient to provide representation of the community if these members are active and participate in the group regularly. Governance have advised that in instances where a member is absent for three consecutive meetings of the AAC without an apology, on request of the AAC or Community Capacity Builder Aboriginal, they provide formal correspondence from the Council to confirm the members intention regarding their membership. To date this has not occurred.

Combine ‘4.4 Community Member Appointments’ and ‘4.5 Term of Office’ into one section to remove duplication (outlined below).

4.4 Community Member Appointments

·    Amended title to ‘Membership Appointments’

·    Set out the process for new member appointments. ‘An interview panel will consist of a Council staff member, the Chair of the Aboriginal Advisory Committee and one (1) Aboriginal Committee representative to assess the applications against the agreed criteria for the Committee. Appointment recommendations of AAC to be submitted to Council at the next Ordinary Meeting for endorsement’.

·    Addition ‘This process does not apply to Government/Non-Government agencies/organisation such as NPWS representative or LALCs delegates who will be nominated by the representing organisation/agency’.

Governance advised to amendCouncillor membership will be renewed at following normal Council elections’ to ‘Councillor membership will be re-affirmed at the Call Meeting in September of each year’.

4.5 Term of Office

·    Dot points removed and combined with 4.4 to avoid duplication.

4.6 Meeting practices and procedures

·    Amendment ‘The Chair of the Committee will be appointed from the Aboriginal Members of the Committee; a Chair can be either a community member or nominated LALC representative on the AAC membership’.

·    Addition ‘In instances where the Chair is not present to perform their duties the Committee will appoint an Acting Chair for the meeting’.

·    Addition ‘Chair of Committee may make representation to Council on recommendations from the Aboriginal Advisory Committee through the formal Deputation process’.

Advice has been taken from Governance on the process and wording for making representation to Council on recommendations made by the Committee and the Deputation process and as such has proposed amendments and additions as outlined above.

Governance has advised that the format for Committee meetings is determined by the Office of Local Government guidance and is legislated in the Local Government Act 1993. The provisions for remote meetings in the Act are currently being reviewed, and for this reason, it is not possible to include ‘include video conferencing’ as an amendment in the TOR at this time.

·    Amendment If a quorum is not present within 30 minutes of the time appointed for the commencement of the Advisory Committee meeting, the meeting will be adjourned or re-scheduled to a time and date set by the CEO’

·    Amendment ‘Items in the minutes which are recommendations to Council will be submitted to the next available meeting. AAC Meeting minutes will be confirmed at the next AAC meeting’.

Governance have requested that the following amendment be made:

·    ‘Governance will aim to circulate Agendas for Advisory Committee to members at least seven (7) days prior to the meeting’.

4.8 Confidentiality and Privacy

·    Addition ‘or is doing so in their capacity as a nominated representative of an organisation’.

4.12 Responsibility of Council

·    Amendment to ‘Councils’ discretion to consider the views of the Advisory when making changes to TOR, Role and Structure of the Advisory Committee’ with the addition of ‘taking into account the views of the Advisory Committee’.

 

Community Engagement

AAC were consulted on the proposed changes to the TOR review workshop in September 2021. Four members of the AAC attended.

 

Policy Implications

Information shared during the workshop was taken into consideration for the proposed amendments to the TOR. Should the AAC wish to make any future changes to the TOR, a recommendation to Council will be required. Following the TOR workshop, the suggested amendments were reviewed by Governance and some adjustments have been made to reflect guidance received; these have been outlined above.

Reason for Report

To provide an update to the Aboriginal Advisory Committee on progress made against actions and resolutions that have been passed at previous meetings of the Shoalhaven Aboriginal Advisory Committee.

Background

Progress towards the completion of actions and resolutions that have been made at previous meetings of the Shoalhaven Aboriginal Advisory Committee are detailed in Attachment 1.

It is recommended that items relating to the Plan of Management, DA and DPOP Budget bid of Cullunghutti be completed and removed as the land has now been transferred back to the Aboriginal community and consequently the ownership of these no longer belong to Council.

Other items relating to the Terms of Reference workshop and consideration of Ron Carberry have taken place and been resolved.

 

Community Engagement

It is important the members of the Aboriginal Advisory Committee are kept informed about progress towards the completion of actions and projects that have been the subject of discussion at meetings of the Committee. This report provides a structured approach to facilitate this information exchange.

AA21.18     Cultural Signage - Kangaroo Valley

That the Aboriginal Advisory Committee provide feedback on the proposal to install cultural signage at Kangaroo Valley.

 

 

Details

Given it was recently NAIDOC week many residents at Kangaroo Valley have expressed interest in supporting Aboriginal language / signposting on entry to the village.

Kangaroo Valley residents group members have contacted their local representatives to request that Council provide an Aboriginal sign identifying the Aboriginal name for Kangaroo Valley. This has been done in other towns and villages across the Shoalhaven and Kangaroo Valley would like to honour the Aboriginal community in the same way.

They request a tasteful inclusion of acknowledging that they live in Dharawal Country. As discussed with the KV community it is imperative to run this by the Aboriginal Advisory Committee, Shoalhaven Tourism Advisory Group, and Inclusion & Access Advisory Group before any actions are undertaken.

 

 

Staff Note:

Council has been advised that there are many different opinions within the local Aboriginal communities about what land ‘we stand on’ with several different tribes requesting different names to be acknowledged as traditional custodians of the Shoalhaven.

Therefore Council has a need to tread carefully when acknowledging Country as this is a highly emotive subject for those involved which is one of the reasons that to date, signage acknowledging Country has not been placed.
