A statement was played advising those present that the proceedings of this meeting (including presentations, deputations and debate) will be webcast and may be recorded and broadcast under the provisions of the Code of Meeting Practice.
A statement was read by the CEO, reminding Councillors joining remotely that, under the provisions of the Code of Meeting Practice, a councillor must give their full attention to the business and proceedings of the meeting when attending a meeting by audio-visual link. Further, the CEO stated that the councillor’s camera must be on at all times during the meeting except as may be otherwise provided for under the Code of Meeting Practice.
The meeting was opened by an Acknowledgement of Country by the Chairperson, followed with a Moment of Silence & Reflection and the playing of the Australian National Anthem.

Engage a suitably qualified consultant to collect necessary associated data and to prepare a Review of Environmental Factors (REF) on the proposed access and off-leash arrangements at Narrawallee Beach, as detailed in MIN25.334 in accordance with s 5.5(1) of the Environmental Planning and Assessment Act 1979 (NSW), namely: a. From 2 October to 30 April timed dog off-leash access on Narrawallee Beach during the following times: i. Australian Eastern Daylight Savings Time: 4pm to 8am; and ii. Australian Eastern Standard Time: 3pm to 10am. b. Provision of dog on-leash access from the Victor Avenue steps and the Surfers’ Avenue steps to the dog off leash area. 4. RESOLVED MIN25.401C That Council 1. In accordance with Section 178(1)(b) of Local Government (General) Regulation 2021 decline to accept any Tender for Waste Transportation Services – Hook Lift Bins as each Tender submission did not meet mandatory criteria of the request for tender or significantly exceeded the allocated budget and pre-tender estimate. 2. In accordance with Section 178(3)(e) of Local Government (General) Regulation 2021 authorise the CEO (delegated officer) to enter into negotiations with any persons (whether or not the person was a tenderer) with a view to entering into a contract in relation to the subject matter of the tender. a. That staff report back the financial implications to Council for determination prior to entering into any agreement. 3. In accordance with Section 178(4) of Local Government (General) Regulation 2021, state the following: a. Council declines to invite fresh tender submissions or applications as referred to in Section 178(3)(b)-(d) of Local Government (General) Regulation 2021, as doing so will not significantly reduce the risk that there will again be no compliant tender submissions, and the shortened timeframe now available to do so risks a period of non-supply of essential servicing. b. Council determines to enter into negotiations with any persons (whether or not the person was a tenderer), to allow it to directly negotiate with hook lift service providers with proven experience in providing the kinds of service requirements identified in the tender, to obtain a value for money outcome. 4. In accordance with Section 179 of Local Government (General) Regulation 2021, a. send to each tenderer whose Tender submission(s) were not accepted a notice to the effect that none of the Tender submissions for the proposed contract were accepted, and b. publish on Council’s public website a notice to the effect that none of the Tender submissions were accepted |
