The Shoalhaven Traffic Committee is a technical review committee, not a committee of Council under the Local Government Act 1993.  Transport for NSW (TfNSW) has delegated certain powers to Council under the Transport Administration Act 1988 (Section 50).  A condition of this delegation is that Council must take into account the Traffic Committee recommendations.

 

There are four formal members of the Traffic Committee, each of whom has a single vote only.  The members are representatives from:

 

If TfNSW or NSW Police Force disagrees with any Traffic Committee recommendation, or Council’s resolution (on any Traffic Committee recommendation), they may lodge an appeal with the Regional Traffic Committee for determination.  The appeal must be lodged in writing within 14 days of the date of notification in writing.  Any action relative to any issue under appeal must cease until the matter is determined.  The Regional Traffic Committee is chaired by an independent chairperson and submissions and representations are welcomed from all interested parties.

 

Council cannot amend a Traffic Committee recommendation. The Council can only: adopt the Traffic Committee recommendation; not adopt the Traffic Committee recommendation, or request the Traffic Committee reconsider the issue.

1.    The Chief Executive Officer (Director City Services) be advised that the Shoalhaven Traffic Committee has no objection to the proposed regulatory ‘Give Way’ signage and linemarking at the intersection of Washburton Road and Pirralea Road, Ulladulla, as per Plan No. D24/69746.

2.    The recommendation be approved by the Director City Services under delegated authority from Shoalhaven City Council - refer MIN21.411.

RECOMMENDATION (By consent)

2.    The recommendation be approved by the Director City Services under delegated authority from Shoalhaven City Council - refer MIN21.411.

The reason for this report is to seek Shoalhaven Traffic Committee approval for the proposed regulatory ‘No Parking’ – ‘Electric Vehicles Excepted While Charging’ signage at 85-87 South Street, Ulladulla, as per Plan No. D24/144577.

 

Recommendation

That:

1.    The Chief Executive Officer (Director City Services) be advised that the Shoalhaven Traffic Committee has no objection to the proposed ‘No Parking’ – ‘Electric Vehicles Excepted While Charging’ signage at 85-87 South Street, Ulladulla, as per Plan No. D24/144577.

2.    The recommendation be approved by the Director City Services under delegated authority from Shoalhaven City Council - refer MIN21.411.

 

Background:

In February 2022, Shoalhaven City Council identified 20 locations across the Shoalhaven for potential Electric Vehicle (EV) charging sites. These locations were selected with consideration to parking spot availability, safety, lighting levels, and the NSW EV Fast Charging Master Plan.

85-87 South Street, Ulladulla was one of the locations identified as being suitable for the installation of an EV charging station. On 4 December 2023, Council resolved the following:

 

RESOLVED                                                                                                                MIN23.700

That Council:

1.    Enter into a ten-year licence with an additional five-year option over part of Lot 11 DP 791198 and Lot 2 DP 717433, 85-87 South Street, Ulladulla with Fast Cities Australia Pty Ltd for the purpose of the provision of an electric vehicle charging station, with the commencing rent being $1,400 plus GST per annum, increased annually by CPI.

2.    Accept the compensation amount of $7,000 (ex GST) to be adjusted according to final survey to Grant an Easement for Electricity Purposes over part Lot 11 DP 791198 for the electricity pad-mount substation and associated infrastructure required in association with the installation of an electric vehicle charging station at 85 South Street, Ulladulla. Note that Fast Cities Australia Pty Ltd will cover Council’s reasonable legal expenses and costs associated with the registration of the easement.

3.    Approves the creation of a Restriction as to User over part Lot 11 DP 791198 and part Lot 2 DP 717433 encompassing the pad-mount substation required in association with the installation of an electric vehicle charging station at 85 South Street, Ulladulla. Note that Fast Cities Australia Pty Ltd will cover Council’s reasonable legal expenses and costs associated with the registration of the Restriction as to User.

4.    Authorises for the Common Seal of the Council of the City of Shoalhaven to be affixed to any documentation requiring to be sealed and delegate to the CEO (Director City Services) authority to sign any documentation necessary to give effect to this resolution.

5.    Include conditions of consent to include appropriate lighting for safety in relevant development applications related to Electric Vehicle chargers.

Details of Submission:

This proposal involves the installation of two ‘No Parking’ – ‘Electric Vehicles Excepted While Charging’ signs along with their associated linemarking over four Electric Vehicle charging spaces. The Licensed Area Agreement specifies that an easement will be provided over one additional parking spot for the housing of electrical infrastructure.

 

Consultation:

Consultation was undertaken with adjacent residents, businesses, stakeholders and closed May 2023. Over the one-month exhibition period, Council received 114 survey submissions on the proposal. 97 responses were ‘in support’ of the proposal. 17 responses ‘against’ the proposal were received. 13 of these were ‘not supportive’ due to the perceived cost to the ratepayer. No traffic related concerns were raised as part of this feedback.

 

Risk Implications:

This proposal designates four parking spaces for electric vehicle charging, whilst removing one parking space for electrical infrastructure. The proposed signage and linemarking will reduce the likelihood of the misuse of these electric vehicle charging spaces.

 

Financial Implications:

There are no financial implications to Council for the installation of these facilities. This proposal would be completed by Evie Networks (Fast Cities Australia Pty Ltd) at their cost.

TC24.10     No Stopping Zone - Booderee Avenue - Hyams Beach (PN 3806)

Reason for Report:

The reason for this report is to seek Shoalhaven Traffic Committee approval for the proposed regulatory ‘No Stopping’ zone, including the associated signage and linemarking along Booderee Avenue, Hyams Beach, as per Plan No. D24/166602.

 

Recommendation

That:

1.    The Chief Executive Officer (Director City Services) be advised that the Shoalhaven Traffic Committee has no objection to the proposed ‘No Stopping’ zone, including the associated signage and linemarking along Booderee Avenue, Hyams Beach, as per Plan No. D24/166602.

2.    The recommendation be approved by the Director City Services under delegated authority from Shoalhaven City Council - refer MIN21.411.

 

Background:

Shoalhaven City Council has received concerns regarding drivers parking on verge next to Booderee Avenue. The parked cars block the usual areas where pedestrians would usually walk forcing them on to the road pavement. To address this issue, Council is proposing to install a ‘No Stopping’ zone to restrict this behaviour between Naval College Road to Illowra Lane. This area is utilised primarily by people wanting to access Hyams Beach when all the parking spaces within the village become full during favourable beach and day trip conditions.

 

Details of Submission:

This proposal would involve the installation of ‘No Stopping’ (R5-400) signs and associated signposts, to be 50m equispaced from one another along Booderee Avenue. To supplement the ‘No Stopping’ signs, ‘No Stopping’ linemarking (NS1) is proposed along Booderee Avenue, from Naval College Road to Illowra Lane equating to approximately 1600m of linemarking.

 

Consultation:

Consultation has been undertaken with Hyams Beach Villagers Association, the adjoining land owners being National Parks & Wildlife Services and Jerrinja Local Aboriginal Land Council. Submissions closed 7 May 2024. Council has received submissions in support of the proposal from Hyams Beach Villagers Association and National Parks and Wildlife Services. It should be noted that Council has received complaints from residents when similar no stopping measures have been temporarily implemented as part of a traffic management plan.  

 

Risk Implications:

This proposal aims to reduce the likelihood of a collision between drivers and pedestrians walking along Booderee Ave between Naval College Rd to Illowra Lane.

 

Financial Implications:

The signage and linemarking for this proposal would be funded by Transport for NSW’s Block Grant Funding allocated to Council for new signage and linemarking.
